I have not yet been able to find the ad that has cost kitkat a lawsuit against atari, it features kitkat bars being broken instead of blocks. I assume atari/kitkat has pulled all of their uploads due to the ongoing lawsuit.
Honestly I didn't even know about that until now... I think I found a pic, is this it?
I'm supposing that it was fully animated and that's just a frame from it. Supposedly it features two children playing it.

Odd. From the articles I've read, this appears to have been a video posted on social media. I even found a bbc article that links to a now deleted Vimeo video, which pretty much confirms it was a video ad. Vimeo has shown themselves to be incredibly delete-happy and basically bow down to companies, like what Youtube has been doing with DMCA.

Well at least we know there's a high probability that this is a video and not an actual game, which makes it harder to find, I doubt a lot of people is going around backing up this stuff, specially since, for what I've seen on YouTube videos which talk about the topic, this thing was deleted like 2 days ago, so there wasn't much time to download it either

Ok it definitely is a video, I found this brief description:
"In Nestle’s advert, which is titled KitKat: Breakout, a group of people play a game where they use a paddle to knock down KitKat pieces instead of bricks"

I found a few more screenshots on a website called arstechnica.com, everything suggest that not only there was a video, but a Facebook playable game was made as well. There's also a tweet but the image is kinda blurry so I can't read what it says. Here's the screenshots:

Damn, they invested a lot more time into this concept than I thought they would. Sad it was all dissolved in the lawsuit. I'd say our best bet is to bet on Atari losing the lawsuit.

Honestly I think this is unbelievable, I mean Breakout is one of the most clonned game in history (including Taito's Arkanoid series which is arguably more well known than Breakout itself), and now all of the sudden they want to protect their old property for an ad campaing which, more than a clone, is a tribute. It seems somebody needs money

I mean, Apple put a breakout clone on the ipod a decade ago, and Atari said nothing.

Found this statement sent by Nestle regarding this whole mess:
"This is a U.K. TV advert that ran in 2016. The ad no longer runs and we have no current plans to re-run it. We are aware of the lawsuit in the U.S. and will defend ourselves strongly against these allegations"
So now we know that this is a UK ad, and that it isn't as recent as we thought
