How can I tell my parents hacking a Wii U/DS isn't piracy and is needed to continue playing?
It's not required to keep playing just in general. The server shutdown only affects the online parts of games, like the multiplayer battles in Splatoon or the GTS in Pokemon for example. If it's a game you already own on cartridge or downloaded to the system you can play it perfectly fine, just not anything that requires you to be online.
For anyone who has already or is planning to mod their consoles, I hear Pretendo has already been working on a fan-recreation of the online services and I'm pretty sure they've even done stuff like run their own Splatfest! Stuff like that is actually needed if you want keep playing online. I'm pretty excited to look into it further when I get off my lazy butt and mod my Wii U.
But anyway to answer your original question, just say it's not piracy. You aren't downloading games illegally and it's not illegal to modify your console. It kinda sounds like they conflate homebrew with piracy, which is actually pretty fair since I think a lot of people who do one do a helluva lot of the other. Me personally I'll be rolling around in my grave before I spend a hundred bucks on a 3DS game!!

You can play the singleplayer story but otherwise, yeah. There's two other games that are still playable. You can get Splatoon 2 secondhand for pretty cheap by switch game standards and they're still updating 3 (for now,anyway). There'll be a new Splatfest on 3 later this month.
